Tổ chức này được ra đời ngày [[15 tháng 3]] năm [[2006]] theo nghị quyết (A/RES/60/251) sau khi Đại Hội đồng Liên Hiệp Quốc thông qua nghị quyết thành lập một tổ chức nhân quyền mới, thay thế một [[Ủy ban Nhân quyền Liên Hiệp Quốc (2006)|Ủy ban Nhân quyền Liên Hiệp Quốc]] đã chấm dứt hoạt động năm 2006.
 
Nghị quyết này được sự ủng hộ của hầu hết các thành viên Liên Hiệp Quốc, trừ [[Hoa Kỳ|Mỹ]], [[Israel]], [[Palau]] và [[quần đảo Marshall]] bỏ phiếu chống và [[Belarus]], [[Iran]] và [[Venezuela]] bỏ phiếu trắng.
