This image is not in the public domain, but there are several reasons which justify its placement in Thriller 25 under wikipedia's fair use policy:

1. There is no other equivalent image which would serve the same, information purpose in this article. It is unreplacable with anything else.

2. No profit is being accrued by wikipedia or detracted from Michael Jackson, Sony BMG, or anyone associated with Thriller 25, by this image being placed on this page.

3. The image is extremely relevant to the article and serves an important purpose by allowing for a visual representation of the subject matter.

For these reasons, I personally believe that this image falls under WP:WPFU.
